2. The petitioner seeks bail in connection with Udwantnagar P.S. Case No. 526 of 2023 instituted for the offences under Section 395 of the Indian Penal Code.

3. As per prosecution case, the accusation against the unknown criminals of looting the truck bearing Registration No. BR-44G-0433.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case on the basis of suspicion. The petitioner is not named in the F.I.R. and his name has transpired in this case in course of

No.17502 of 2025(2) dt.28-03-2025 2/3 investigation on the basis of the confessional statement of the apprehended co-accused Om Prakash before this police which has no evidentiary value in the eye of law. Except confessional statement of the co-accused, nothing has come against the petitioner in the entire record of the case. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner or from his house. No T.I.P. has been has been held in this case as yet. The petitioner has one criminal antecedent and is languishing in judicial custody since 12.01.2025 without any rhymes or reason.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature. He further submits that the name of the petitioner has surfaced in this case on the basis of the confessional statement of the co-accused Om Prakash. Learned counsel for the State further submits that the prayer for bail of the co-accused namely Om Prakash Singh and Sumit Kumar @ Brajesh Kumar has already been rejected by a Co-ordinate Bench of this Court vide orders dated 17.12.2024 and 07.08.2024 passed in Cr. Misc. Nos. 78140 of 2024 and 51727 of 2024 respectively.

6. Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.17502 of 2025(2) dt.28-03-2025 3/3 considering facts and circumstances of the case as also the nature and gravity of the offence, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for bail of the petitioner, above named, is rejected with a direction to the court below to expedite the trial and conclude the same expeditiously. (Rudra Prakash Mishra, J) rishi/- U T
