The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 467, 468, 120B of the Indian Penal Code. The prosecution case is that Ashok Kumar Gupta, the cousin of the informant has executed a sale deed appertaining to land of khata no. 295, plot no. 818, measuring an area of 3 1⁄4 decimals in favour of petitioner no. 1 Rajendra Prasad, whereas petitioner no. 2 Dharamdeo Prasad is a witness to the sale deed. Subsequently, the informant entered into the compromise with his cousin, but the petitioners threatened the informant to execute a sale deed.
Patna High Court Cr.Misc. No.20068 of 2016 (2) dt.05-05-2016 It is submitted by the learned counsel for the petitioners that informant has filed Title Suit No. 220 of 2015 for cancellation of sale deed executed by petitioner no.
1. Petitioner no. 1 is a bona fide purchaser. Considering the accusation levelled in the background of civil nature of dispute, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 33 of 2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) P.K./- U T
