The petitioners apprehend their arrest in connection with K. Nagar P.S.Case No. 569 of 2013 registered for the offences punishable under Section 307 and other sections of the Indian Penal Code.

The Circle Officer, Purina, made an allegation that 150-200 persons assembled on the land of Parora Pragya Bihar Girls School and they started constructing the house. The accused persons were armed with bows and arrows and other lethal weapons.

Learned counsel for the petitioners submits that 80 persons are named in the FIR but the petitioners are not named in

Patna High Court Cr.Misc. No.32807 of 2014 (2) dt.02-02-2015 2/2 the FIR. There is no specific allegation against the petitioners. It is further submitted that persons arrested on the spot have already been enlarged on bail. The name of the petitioners figured later on during course of investigation.

Having considered the fact that the petitioners are not named in the FIR but the name of the petitioners figured later on during course of investigation and no specific allegation has been made against the petitioners, let the above named petitioners, in the event of their arrest/surrender before the learned court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea, in K.Nagar P.S.Case No. 569 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
