JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 302 and 120/34 of the Indian Penal Code. Allegation against the petitioners is that they threatened the informant not to contest the Panchayat Election otherwise he would be killed.

It has been submitted on behalf of the petitioners that they have been falsely implicated in the present case. It is further stated that petitioners have been made accused in the present case merely on the basis of suspicion. There is no direct or indirect allegation with regard to implication of the petitioners in the present case.

On behalf of the State, it is submitted that the petitioners have been named in the F.I.R. merely on the basis of suspicion. Considering the aforesaid facts, let the above named petitioners, in the event of arrest or surrender in the court below

Patna High Court Cr.Misc. No.25192 of 2015 (3) dt.21-09-2015 2 / 2 within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Majhauliya P.S. Case no. 100 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
