The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that the petitioner married with the victim girl and now they have three children and the informant has retracted from his initial version and filed a petition to that effect before the learned court below.
Since the case was instituted in 2005, this Court is not inclined to grant anticipatory bail. The aforesaid facts may be considered by the learned
Patna High Court Cr.Misc. No.33775 of 2014 (3) dt.18-02-2015 2 / 2 court below while considering prayer for regular bail of the petitioner if he surrenders within a period of six weeks from the date of receipt of copy of this order in connection with Jamo Bazar P.S. Case No. 54 of 2005 pending in the court of the learned C.J.M. Siwan.
With this observation, the application is disposed off.
