The petitioner seeks pre-arrest bail in connection with Raniganj P.S. Case No. 64 of 2016 registered under Sections 272 and 273 of the Indian Penal Code as well as Section 47(A) of the Excise Act.

Regard being had to the recovery of 25 liters of illicit country made liquor from the house of the petitioner, I am not inclined to grant him pre-arrest bail. Accordingly, the application preferred under Section 438 of the Code of Criminal Procedure is rejected.

In case the petitioner surrenders and seeks bail, the

Patna High Court Cr.Misc. No.21619 of 2016 (2) dt.25-05-2016 2/2 same shall be considered on its own merits without being prejudiced in any manner by this order.
