====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 03-09-2020 Due to COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding.

The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence registered under Sections 394 and 411 of the I.P.C. The prosecution story, in brief, is that while the informant was coming after selling rice by a Tempo coming from Bihta Bazar on which four F.I.R. named accused persons including the petitioner were also seated. They also assaulted and snatched Rs. 28,500/- from the informant on the point of

Patna High Court CR. MISC. No.16907 of 2020(3) dt.03-09-2020 2/3 knife. The police arrested them with the help of local people and the alleged money was recovered from the pocket of the petitioner.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 02.10.2019. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to village politics. The recovered money in question belongs to the petitioner. It is further submitted that the petitioner may be released on bail after completion of one year in custody. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the facts and circumstances of the case and also the lockdown, the petitioner above named, is directed to be released on bail after completion of one year in custody on his personal bond to the satisfaction of the learned A.C.J.M.-1, Danapur, Patna, in connection with Bihta P.S. Case No. 909 of 2019.

Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/-(Rupees Ten Thousand) with
