JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 324, 354, 354 C, 379, 448 and 504/34 of the Indian Penal Code and Sectin 3 / 4 of the Dian Act. Allegation against the petitioners is that they called the informant as Dian and also assaulted her.

It is submitted on behalf of the petitioners that they have got no criminal antecedent. It is a case and counter case between the parties. Both the parties are agnates. The alleged date of occurrence is 30.8.2015 and the case was instituted on 3.9.2015. The delay has not been explained by the prosecution. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each

Patna High Court Cr.Misc. No.21546 of 2016 (3) dt.27-06-2016 2/2 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Turkaulia P.S. Case no. 646 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
