2. The petitioner has prayed for bail in connection with Danapur P.S. Case No. 98 of 2025 registered for the offence punishable under Sections 310(2) and 317(3) of B.N.S.

3. The case of the prosecution, in short, is that unknown miscreants have looted jewellery from the shop of informant, namely, M/s. Jiva Jewellery shop on gun point.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The F.I.R. was lodged against unknown miscreants.

No.17803 of 2026(2) dt.23-03-2026 2/3 During course of investigation, Deepak Kumar and Rohit Kumar have given their confessional statement and in the confessional statement of these two persons, name of this petitioner has surfaced. It has further been submitted that nothing has been recovered from his possession. From perusal of the order of the learned trial Court it will transpire that certain articles were recovered on the confessional statement of one Sarita Devi. It has also been submitted that till today, there has been no T.I.P. of person or the articles. Petitioner is languishing in judicial custody since 19.09.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of 13 cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Danapur in connection with Danapur P.S. Case No. 98 of 2025 with the following conditions:- (I) The petitioner shall cooperate in the trial and

(ii) He shall also mark his attendance weekly at Hajipur Town P.S.
