The petitioner seeks bail in connection with Bettiah Town P.S. Case No. 306 of 2016 dated 14.06.2016 instituted for the offences under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

The servant of the informant was found dead in front of his house with gun shot injuries. The FIR has been registered against unknown. During the course of investigation, the name of the petitioner was taken by one spy. Later, the telephone number of the petitioner was also obtained and from the CDR report, it appeared to the investigating officer that the location of the petitioner was, at the relevant time, found near the dead body. That apart, it has been argued that there is no material to connect

Patna High Court Cr.Misc. No.48777 of 2017 (3) dt.01-12-2017 the petitioner with the crime. The petitioner, though, has been made accused in about five other cases but in most of the cases, he is on bail.

Taking into account the fact that the petitioner is in custody since 20.06.2017 and the paucity of materials against him, this Court is inclined to grant bail to him.

In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bettiah Town P.S. Case No. 306 of 2016.
