JUSTICE PARTHA SARTHY ORAL ORDER 24-06-2020 Heard learned counsel for the petitioner and learned A.P.P for the State, through video conferencing. The petitioner has filed the instant application for grant of bail in connection with Rajeev Nagar P.S. Case no. 451 of 2019 registered under section 365 of the Indian Penal Code. As per allegation in the F.I.R., the cousin brother of the informant was kidnapped on way to his going home and it is stated that subsequently the informant received a phone call from a mobile phone stating that his cousin was in his custody. It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in the confessional statement of one Navlesh Kumar who has been enlarged on bail vide order dated 5.6.2020 passed in Cr.Misc. no.83784 of 2019.

No.14781 of 2020(5) dt.24-06-2020 2/2 It is submitted that besides the confessional statement of Navlesh Kumar and some unfounded suspicion raised in course of investigation, there is no other material against him. The petitioner has no criminal antecedent and is in custody since 16.9.2019.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, charge sheet having been submitted in the case, grant of bail to the co-accused Navlesh Kumar and the petitioner not having any criminal antecedent, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Rajeev Nagar P.S. Case no.451 of 2019 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. -III, Patna.
