JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 24-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Trial No. 44 of 2017 arising out of Excise Case No. 20 of 2014 registered under Section 47(A)(F) of the Excise Act, 2016. 600 litres of country made liquor kept in three drums allegedly by the petitioner Chuman Patel is said to have been recovered from the canal on secret information. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. The petitioner has no concern either with any business of wine or with the seized liquor.

He was not arrested on the spot. Though six cases have been lodged against the petitioner, but he has been enlarged on bail in aforesaid cases. He has been languishing in custody since 05.06.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Trial No. 44 of 2017 arising out of Excise Case No. 20 of 2014.
