====================================================== CORAM: HONOURABLE MR. JUSTICE RITESH KUMAR ORAL ORDER 25-03-2026 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Jamhore P.S. Case No.270 of 2025, for having allegedly committed offences under Sections 126(2), 115(2), 117(2), 109, 303(2), 76, 351(2), 352 and 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the informant, Dolly Devi gave a written report to the effect that on 02.12.2025, all the named accused persons including the petitioners were taking away the bundle of paddy from the field and when the informant told them not to do so, they badly assaulted the informant and her husband with iron rod and Lathi and the accused persons

4. The learned counsel for the petitioners submits that the petitioners are innocent and there is a case and counter case since, the petitioner no.1 has also filed Jamhore P.S. Case No.271 of 2025 against the informant of the present case and her family members under Sections 191(2), 191(3), 126(2), 115(2), 117(2), 109, 118(1) and 303(2) of the B.N.S., 2023. It has further been submitted that Title Suit No.293 of 2025 is pending in between the parties for land dispute and the present case is on account of the said land dispute. It is also submitted that as per the impugned order, passed by the learned District & Additional Sessions Judge-V, Aurangabad, injury on the left thumb and middle of the head has been found on the part of the informant and from the C.T. Scan, the same appears to be simple in nature. The allegation of assault on the informant has been levelled against the petitioner no.2 and there is general and omnibus allegation against the petitioner no.1.

5. The learned A.P.P. for the State opposes the prayer for bail.

6. After having heard the learned counsel for the parties and considering the facts that the injuries are simple in nature, there is case and counter case in between the parties and

No.18090 of 2026(2) dt.25-03-2026 3/3 a title suit is already pending, let the petitioners, above-named, in the event of their arrest or surrender within a period of six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- VII, Aurangabad in connection with Jamhore P.S. Case No.270 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S. with a further condition that:- The court concerned shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court concerned shall take steps for cancellation of bail bonds of the petitioners. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
