JUSTICE RAKESH KUMAR ORAL ORDER 20-05-2016 Heard Sri Naval Kishore Singh, learned counsel for the petitioners and learned A.P.P.

Three petitioners, apprehending their arrest in connection with Bagaha (Bhairoganj) P.S. Case No. 53 of 2016 registered for the offence under Sections 147, 149, 341, 323, 307, 504, 427 and 506 of the Indian Penal Code, have prayed for grant of anticipatory bail.

Learned counsel for the petitioners while pressing the petition submits that on trivial issue occurrence has taken place. He submits that so far petitioner no. 1 is concerned, there is no allegation of overt act. He further submits that injuries, which were received from the informant's side were simple in nature,

Patna High Court Cr.Misc. No.22500 of 2016 (2) dt.20-05-2016 2/2 which is corroborated from the copy of the injury report i.e. Annexure - '2' series. It has also been argued that at least two accused persons in similar circumstances have been granted bail by the learned court below after keeping them in custody for some days, and as such, no purpose would be served in keeping the petitioners in custody.

Besides hearing, I have also perused the material available on record. I do not find any ground for extending the privilege of anticipatory bail.

The petition stands dismissed.
