JUSTICE ARUN KUMAR ORAL ORDER 15-01-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Mohania PS Case No. 631 of 2017 registered under Sections 406, 420 and 506 of the IPC.

The allegation in brief is that on assurance of providing private job the petitioners sought. 17,500 rupees and some security money was also deposited and engaged the informant in a private company where work was taken by the company for two months as a cook without providing any salary and was asked to bring further two boys to work as cook only then salary would be paid to him. Learned Counsel for the petitioners submitted that the allegations do not attract ingredients of breach of trust, moreover no such money was taken by petitioner No. 1 and the petitioners are in custody since 13.11.2017.

Having considered the said facts and circumstances, the petitioner, namely, Kanhaiya Das, Dharmendra Kumar and Amitabh Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Kaimur at Bhabhua in connection with Mohania PS Case No. 631 of 2017.
