The petitioner seeks bail in a case registered under Sections 376(3)/376DA/354(D)(II)/341/342/323/452/34 of the Indian Penal Code as well as Section 6 of POCSO Act and 67/67(A)/67(B) of Information Technology Act, 2008. Allegation is that the accused persons committed rape upon the victim.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.10.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. As per the medical report, no sign of rape has been found. The petitioner has been made accused for

Patna High Court CR. MISC. No.20460 of 2019(3) dt.01-05-2019 2/2 oblique reasons. Other co-accused has been granted bail vide Cr.Misc.No.20394 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st-cum-Special Judge (POCSO Act), Gaya in connection with Gaya Muffasil P.S. case No.356 of 2018.
