JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Heard learned counsels for the petitioner, informant and learned counsel for the State The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No. 32 of 2015 for the offences instituted under Sections 420, 467, 468, 471 and 120(B) of the IPC. The prosecution story, in brief, is that when the informant alongwith the present Secretary went to Punjab National Bank, Gorasara, Ramgarh, to submit the application for changing the name in the account of the said society and giving their specimen signatures to the bank, she was informed that an amount of Rs.6,90,000/- from the Account of the Society had been withdrawn leaving only Rs.1,360.90 in the said Account. Patna High Court Cr.Misc. No.25835 of 2015 (3) dt.22-09-2015 2/3 reported that the former Secretary, namely, Manju Devi and her daughter Miss Kriti Kumari had withdrawn the said amount by putting forged signature of earlier Administrator Mr. Harendra Prasad Rai.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is the Branch Manager of Punjab National Bank. As per prosecution case, it is alleged that the Ex-Administrator of PACS had made withdrawal from the account of PACS. The informant of the present case is the present Chairman of PACS. She has alleged that by making a forged signature of the ExAdministrator, the said withdrawal has been made from the account of the Bank. It is further submitted that the alleged money was withdrawn in between 26.09.2014 to 10.01.2015 which was done on the original certified signature. It is further submitted that no mistake has been committed on the part of the petitioner and the petitioner is not involved in any manner in the alleged occurrence.

On behalf of the learned counsel for the State it has been submitted that there is nothing in the entire case diary to indicate that the signature of the Ex-Administrator by which withdrawals were made is fake signature.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Ramgarh P.S. Case No. 32/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Kaimur at Bhabua, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
