The petitioner seeks bail in a case registered for the offence punishable under Sections 30, 30(a) of the Bihar Prohibition and Excise Act, 2016.
78 liters of foreign liquor is said to have been recovered from the Marshal vehicle which is said to have been brought by Ravi Singh and Pawan Singh and petitioner was unloading the said liquor from the vehicle and was apprehended in the course of escaping from the aforesaid place.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious
Patna High Court Cr.Misc. No.38610 of 2018 (02) dt.03-07-2018 - 2 - physical possession of the petitioner. He has no concern either with the seized liquor or the vehicle in question. The seizure list does not bear the signature of the petitioner. He happens to be a simple labourer and was unloading the cartoon from the vehicle without any knowledge of its contents on petty remuneration. He has no criminal antecedent and has been languishing in custody since 24.03.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th A.D.J.-cumSpecial Judge Excise, Nalanda, Biharsharif in connection with Nalanda P.S. Case No. 48 of 2018.
