The petitioner, already in custody, seeks bail in connection with Bhaktiyarpur P.S.Case No. 71 of 1996 registered under Sections 302/34 of the Indian penal Code. Petitioner is an accused in a case of triple murder but not named in the FIR but later on his name transpired. The case is of the year 1996 and charge sheet against him was submitted declaring him absconder in the year 1998, since then he had been absconding and remanded in this case on 24.12.2017 from another case.

Submission is that he is admitted in hospital because he received injury in firing in the Civil Court campus and charge has been framed.

Patna High Court Cr.Misc. No.59365 of 2017 (3) dt.19-01-2018 2/2 Having considered the aforesaid facts and circumstances of the case, especially remained absconder for approximately 19 years, so the Court is not inclined to grant bail to the petitioner. Accordingly, prayer for bail stands rejected. However, trial court is directed to expedite the trial. (Arun Kumar, J) Sujit/- U T
