The petitioner seeks regular bail in connection with Ujiarpur PS case no. 27 of 2018 registered for the offence punishable under Sections 394 of Indian Penal Code and 27 of Arms Act.
The allegation is regarding 46 mobile phones of the informant having been stolen by unknown miscreants on pistol point and subsequently, during the course of investigation, 15 mobiles are said to have been recovered from the shop of the co-accused namely Md. Afjal.
The learned counsel for the petitioner submits that as far as the petitioner is concerned, no recovery has been made from him, however he has been falsely implicated in the
Patna High Court CR. MISC. No.17185 of 2019(2) dt.02-04-2019 2/2 present case without any T.I. parade being held till date so as to implicate him in the alleged crime. It is further submitted that the co-accused Md. Afjal has already been granted bail by a coordinate Bench of this Court vide order dated 07.05.2018 passed in Cr. Misc. no. 28232 of 2018. It is next submitted that petitioner is accused in two other cases also but he is on bail in said cases. The petitioner is said to be languishing in custody since 29.06.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Dalsingsarai in connection with Ujiarpur PS case no. 27 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
