JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends her arrest in Sultanganj P.S. Case No. 175 of 2016, G.R. No. 2821 of 2016 registered for the offence under Sections 406 & 420 of the Indian Penal Code. It is submitted on behalf of petitioner that petitioner is not named in the FIR. Name of petitioner has come during course of investigation. It is further submitted that only allegation against this petitioner is that the mobile no. 9572108022, by which informant was directed to deposit the amount, stood in the name of this petitioner. In fact, no such amount has been credited into the account of the petitioner. However, during course of investigation, it was revealed that aforesaid mobile was being used by co-accused Kunal Kumar.

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Patna City (Patna) in connection with Sultanganj P.S. Case No. 175 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
