The petitioner seeks bail in connection with Sasaram P.S. Case No. 107 of 2024 instituted for the offence under Sections 303(2), 317(2) & 313 of the Bharatiya Nyaya Sanhita, 2023.

As per prosecution case, the petitioner was caught snatching a purse on a train at Dehri on Sone station. On search, there is recovery of jewellery, cash, a phone and an iron punch from his possession.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14-08-2024. Petitioner

Patna High Court CR. MISC. No.18816 of 2025(2) dt.02-04-2025 2/3 bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that petitioner was watching the train to go to Singrauli, but merely on suspicion, he was apprehended by the police. Learned counsel for the petitioner next submits that petitioner is a farmer and only earning member of his family. No incriminating article has been recovered from the possession of the petitioner. There is no compliance of Section 103 of the BNSS, 2023. Charge sheet is submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, charge sheet being submitted and nature of accusation, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sasaram
