ANJANA MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 09.07.2017 in connection with Kanti P.S. Case No.253 of 2017 registered for the offences under Sections 398, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but subsequently after eight days his name has been brought in on mere suspicion. Till date, no T.I. Parade has been conducted and there is no eye-witness to the occurrence.The petitioner is also not having any criminal antecedent and no recovery was made from his possession. In view of the aforementioned facts and circumstances,

Patna High Court Cr.Misc. No.58711 of 2017 (2) dt.12-12-2017 2/2 let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, West, Muzaffarpur, in connection with Kanti P.S. Case No.253 of 2017.
