2. The petitioner has preferred this application for grant of regular bail in connection with Nawada Cyber P.S. Case No. 68/2024 dated 08.12.2024 registered for the offence punishable u/s 303(2), 318(2), 318(4), 338, 319(2), 336(2), 336(3), 340(2), 111 and 61(2) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons were apprehended and from the possession of the petitioner and the co-accused persons mobile phones were recovered. On search, whatsapp chat regarding fraud was found. Later, the co-accused persons disclosed that the petitioner along with other co-accused persons was involved in committing fraud in the name of giving franchise.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is in custody since 09.12.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that two mobile phones were recovered from the possession of the petitioner.

6. In view of the fact that the petitioner is involved in cyber fraud, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed. (Sandeep Kumar, J) Vikas/- U
