JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302 and 120B of the Indian Penal Code. Allegation against the petitioner is that he is also involved in killing husband of the informant. It is submitted on behalf of the petitioner that he has got no criminal antecedent. Petitioner has been made accused merely on the basis of suspicion. According to informant, the deceased had received a call from the petitioner in the night and thereafter he had left his house. Next morning his dead body is said to have been recovered. Except for this there is no other direct or indirect evidence to suggest his implication in the present case. No motive has been alleged against the petitioner for committing the alleged offence.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail

Patna High Court Cr.Misc. No.21144 of 2016 (4) dt.12-07-2016 2/2 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea, District-Purnea in connection with Dagarua P.S. Case no. 242 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
