JUSTICE SANJAY KUMAR ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks regular bail in connection with Teghra Police Station Case No. 233 of 2017 registered for offences under sections 25 (1-b)a and 26 of the Arms Act. The above case has been registered on the basis of self statement of S.H.O. of Teghra Police Station. The informant has alleged that on 19.08.2017 while he was on patrolling duty on the occasion of Krishna Janamasthmi found the petitioner in suspicious condition. On search a loaded country-made pistol was recovered from his possession. It has been submitted that the petitioner has been wrongly implicated in the present case. The alleged recovery was made during Mela where a large number of

Patna High Court Cr.Misc. No.57120 of 2017 (2) dt.12-12-2017 2/2 people are supposed to have assembled, but not a single independent witness has signed the seizure list. The seizure list was signed by two police Constables. The petitioner having clean antecedent is in custody since 19.08.2017.

Considering the facts and circumstances of the case, the prayer for bail is allowed and the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Teghra Police Station Case No. 233 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
