It is case of the petitioners that late Raj Kishore Singh died in harness on 30-06-2021 leaving behind his widow (petitioner no. 1), only son who is petitioner no.2 and three daughters. Two daughters are married whereas one is unmarried. Learned counsel for the petitioners submits that as per the scheme of the Bank, the petitioner no.2 applied for appointment on compassionate ground but in course of consideration of his application, a dispute arose as to the name of the sons and daughters of the deceased employee. Learned counsel has drawn the attention of this Court towards a communication received from the HRD department dated 23-11-2022 (Annexure 3 to the writ application ) in which it is stated that in the HRMS the deceased employee had given names of his sons and had claimed that he had two sons namely Chandan Kumar Singh and Arun Kumar Singh and one daughter namely Chanda Kumari. In his personnel file he had given the name of his dependents in which he wrote the name of his son as Akash kumar and Amit Kumar.

Learned counsel submits that petitioners were called upon to explain the discrepancies.

It is stated that the petitioners have submitted a reply

Patna High Court CWJC No.5176 of 2023(2) dt.03-05-2023 3/3 vide Annexure 4 to the writ application to the HRD Department, Circle Head, Muzaffarpur, and vide Annexure 5 the Chief Branch Manager of the Bank has also been informed. Mr. Suresh Prasad Singh No.1, learned counsel for the Bank submits that at this stage the Bank has already conducted the verification and it has been found that petitioner no.2 is the son of the deceased employee, therefore the records have been sent for further consideration.

In the aforesaid view of the matter, this Court directs the competent authority of the Punjab National Bank and the respondents to consider the case of the petitioner no.2 for appointment on compassionate ground and take a decision thereon as per the Bank's policy within a period of three months from the date of receipt/ production of a copy of this order. This writ application stands disposed off.
