Petitioner seeks bail in a case registered for the offences punishable under Sections 406,420/34 of the Indian Penal Code and Section 3 of the Bihar Protection of Interest of Depositors Act, 2002.
The allegation of defalcation of money as well as cheating is against Sun-Plant Agro Company Ltd. Further allegation is that at the instance of this petitioner, money was deposited by the informant in the said Non-Financial Company to get better interest.
Submission of the learned counsel for the petitioner is that the wife and son of the petitioner had also deposited money with the said Company vide Annexure-4
Patna High Court Cr.Misc. No.1394 of 2018 (5) dt.30-03-2018 series to the supplementary affidavit and they have also been cheated.
Considering the aforesaid Submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Amarpur (Fullydumar) Police Station Case No.580 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
