The petitioner seeks regular bail in connection with Sahebganj PS case no. 197 of 2018 registered for the offence punishable under Sections 461, 379 of Indian Penal Code and 25(1-B)a, 26/35 of Arms Act.

The allegation is regarding the petitioner having been caught by the villagers while he was trying to commit theft in a shop. It is further alleged that after the petitioner was arrested and the search was made, one countrymade loaded pistol and other articles used for cutting locks were recovered. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on account of village politics and he is having a clean

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st (West) Muzaffarpur in connection with Sahebganj PS case no. 197 of 2018.
