JUSTICE ARUN KUMAR ORAL ORDER 31-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Nautan PS Case No. 109 of 2017 registered under Sections 147, 341, 323, 324, 307 and 504/34 of the IPC.

Learned Counsel for the petitioner submits that there is land dispute between both sides and there is case and counter case from both sides. The petitioner also sustained injury in the occurrence, there is no specific overt act alleged against the petitioner rather the allegation is general and omnibus against all the family members, charge-sheet has been submitted in this case and the petitioner is in custody since 7.11.2017 Having considered the said facts and circumstances, the petitioner, namely, Shankar Chauhan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XII, Siwan in connection with Nazutan PS Case No. 109 of 2017.
