JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,149,323,307,353,379,504 and 427 of the Indian Penal Code. The prosecution case is that Kamlesh Yadav, son of Naresh Yadav was killed in a road accident when the mob made protest, blocked the road. When the police went to pacify the issue then the mob pelted stones, abused and assaulted the police personnels and damaged the road by cutting it. It is submitted by the learned counsel for the petitioner that the accusation is against the mob and the police, in order to conceal its own laches, lodged the present case. Patna High Court Cr.Misc. No.22947 of 2016 (2) dt.23-05-2016 2/2 criminal antecedent. More over, other similarly situated accused have been granted anticipatory bail vide Cr. Misc. no. 7742 of 2016.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Nawada, in connection with Pakribarawan P.S. Case No. 132 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
