The petitioner seeks bail in connection with Paroo P.S. Case No. 155/2018 dated 12.05.2018 instituted for the offences under Sections 379, 411 and 34 of the Indian Penal Code. The motorcycle of the informant was attempted to be stolen but the petitioner and other accused persons could not succeed and they were apprehended by the villagers. The petitioner and other co-accused was produced before the police by the villagers.
The learned counsel for the petitioner has submitted that the petitioner has been arrested on mistaken identity in the village. He was going to attend to the call of nature, when it was suspected that he had stolen the motorcycle.
Patna High Court Cr.Misc. No.39593 of 2018 (2) dt.09-07-2018 2/2 Under similar circumstances, the other co-accused, who was arrested along with the petitioner, has been granted bail by the court below.
The petitioner does not bear any criminal antecedent and he is in custody since 12.05.2018.
Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, West Muzaffarpur in connection with Paroo P.S. Case No. 155/2018.
