JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 354 and 307/34 of the Indian Penal Code. It is alleged that the accused persons assaulted the informant by bamboo, spear and with blunt part of sickle and when the wife and the mother of the informant came to rescue they were also assaulted. It is specifically alleged that the petitioner Kundan Chaudhary assaulted with sword to the informant.
It is submitted by learned counsel for the petitioners that superficial injuries have been caused, though, injury reports are not on
Patna High Court Cr.Misc. No.26038 of 2015 (2) dt.02-07-2015 2/2 record. There is counter version of the occurrence also and the informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Saharsa Sadar P.S. Case No. 140 of 2015 pending in the court of learned CJM, Saharsa. Accordingly, the application is disposed of.
