This application has been filed by the petitioner for modification of order dated 07.09.2018 passed in Cr. Misc. No. 37384/2018, which was subsequently modified on 22.01.2020 in Cr. Misc. No.86803/2019, whereby petitioner was granted provisional bail with a condition that that if petitioner refunds rupees 10 (ten) lacs in ten (10) months, the provisional bail shall be confirmed by the court below itself.
However, it is submitted that the petitioner, due to the reasons mentioned in this application, could not refund the
Patna High Court CR. MISC. No.15810 of 2020(4) dt.15-09-2021 2/2 entire amount even within the extended period of 15 days and, thus, petitioner seeks further extension of the time for refunding the remaining amount of rupees one lacs. In the facts and circumstances of the case, this application is allowed and 4 weeks time is further extended from today in which petitioner would be required to refund remaining amount of rupees one lacs and thereafter, provisional bail granted by order dated 07.09.2018 passed in Cr. Misc. No.37384 of 2018 would be confirmed by the court below itself. Accordingly, the order dated 07.09.2018 passed in Cr. Misc. No.37384 of 2018 and order dated 22.01.2020 passed in Cr. Misc. No.86803/2019 stand modified to the aforesaid extent. (S. Kumar, J) Sanjay/- U T
