The petitioner seeks regular bail in connection with Patliputra P.S. Case No. 249 of 2021 lodged under Sections 356, 379 and 411 of the Indian Penal Code.

As per the F.I.R., the allegation upon the petitioner is that he has snatched mobile of the informant and the public at large has caught him on the spot. There is criminal antecedent of the present petitioner also.

Learned counsel for the petitioner submits that the present case is at worst shall be made under Sections 379 and 411 of I.P.C. only and section 356 of I.P.C. is not attracted in the present situation at all. He further submits that petitioner is in custody since 19.05.2021 i.e. more than one year. On the point of criminal antecedent, he submits that petitioner shall not involve in criminal activity in future.

In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-X, Patna in connection with Patliputra P.S. Case No. 249 of 2021, subject to the following conditions:- The petitioner is directed to file an affidavit before the Trial Court that he shall not involve in such type of activity in future. If he shall involve in such type of activity again, the prosecution shall be at liberty to move for cancellation of his bail bond. The petitioner shall appear before the Trial Court on each and every date, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond.

With this observations, the bail application is disposed of.
