2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 307, 379/34 of the Indian Penal Code.
3. It is alleged that all the F.I.R. named accused persons including this petitioner assaulted informant with iron rod and sticks.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation of assault is general and omnibus and there is no specific allegation of overt act against this petitioner. Injuries sustained by the injured are simple in nature. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed
Patna High Court CR. MISC. No.17105 of 2025(2) dt.03-04-2025 2/2 the bail application.
6. Considering the backdrop of the case, nature of accusation, simple injury and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabhua P. S. Case No. 1089 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
