The petitioner is an accused in C-1 Case No. 41 of 2014. The allegation against him is referable to the provisions of the Bihar Excise Act.
A.B.P. No. 828 of 2014 filed by the petitioner has been rejected by the court of Sessions Judge through order dated 18.7.2014.

The name of the petitioner did not figure in the FIR. It is stated that only on the strength of the statement which is said to have been recorded from the persons whose premises were
Patna High Court Cr.Misc. No.33100 of 2014 (2) dt.04-02-2015 2/2 raided, the petitioner is sought to be arrested. The matter needs to be examined in the trial.
Hence, this application is allowed.
It is directed that in the event of arrest, the petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ashish Mishra, Judicial Magistrate 1st Class, Purnea, in connection with C1-41 of 2014.
