Case no. 14/2015 registered under sections 302,201/34 of the Indian Penal Code in which petitioners apprehend their arrest and accordingly, both the above stated petitions are being
disposed of by this common order.
Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Admittedly, victim is still missing and neither she could be recovered alive nor her dead body has been recovered. In course of investigation, some witnesses stated that they heard sound of quarrel coming out from the house of the petitioners on the alleged date of occurrence and after that victim was found missing.
Learned counsel for the petitioners submits that petitioners in Cr. Misc. no. 12494/2015 are in-laws whereas the petitioner in Cr. Misc. no. 16965/2015 is husband of the victim and no specific overt-act has been attributed against these petitioners. It is further contended by him that, as a matter of fact, victim was working as assistant teacher at Jehanabad and she was residing at her matrimonial home. It is further contended by him that on the alleged date, she was got boarded in a bus by the petitioner in Cr. Misc. no. 16965/2015 and thereafter, she was found missing. It is further contended by him that petitioners in Cr. Misc. no. 12494/2015 are parents-inlaw of the victim and old persons and, as a matter of fact, they do not have any concern with the affair of husband of the victim.
Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this
order to the concerned court, let the petitioners in Cr. Misc. no. 12494/2015,namely, Aatmanand Singh, Rita Devi @ Rita Kumari and Vikash Kumar Ranjan @ Babloo Kumar @ Vikash Kumar be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Jehanabad P.S. Case no. 14/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
So far as prayer for anticipatory bail of the petitioner in Cr. Misc. no. 16965/2015, namely, Alok Kumar @ Alok Kumar Ranjan stands rejected.
