The petitioner figured as an accused in Mehandia PS case No. 60 of 2014. The offences alleged against him are those under Sections 341, 323, 427, 448, 504, 506 read with Section 34 of the Indian Penal Code. In addition to that, offence under Section 3(x) of the SC and ST (Prevention of Atrocities) Act has also been alleged. A.B.P. No. 520 of 2014 filed by the petitioner in the court of Sessions Judge was dismissed through order dated 22.7.2014. Hence, this application.

Heard Sri Akhileshwar Prasad Singh, learned Sr. Advocate for the petitioner and Sri Sadanand Paswan, Spl. P.P. Almost all the offences referable to the provisions of the

Patna High Court Cr.Misc. No.33121 of 2014 (2) dt.04-02-2015 2/2 Indian Penal Code are bailable. The gravity is only with reference to the offence referable to SC and ST (Prevention of Atrocities) Act. From a perusal of the record, this Court prima facie finds that there is a serious property dispute between the complainant and the petitioner. The details of the dispute are not being mentioned so that there may not be any effect on the trial. Hence, this application is allowed.

It is directed that in the event of arrest, the petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Shashi Kant Rai, Judicial Magistrate 1st Class, Jehanabad in connection with Mehandia PS case No. 60 of 2014.
