The petitioners are apprehending their arrest in connection with Bibhutipur P.S.Case No.249 of 2017 , registered for offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

Allegation against the petitioners is that they along with the other accused persons thrown chilly powder in the eyes of the informant and thereafter all the accused persons assaulted him.

Submission of the learned counsel for the petitioners is that Bipati Devi is the sister of the informant and as she settled in her Maike , the informant was not agreed by the same and

Patna High Court CR. MISC. No.20073 of 2019(4) dt.19-06-2019 2/2 lodged the police case and further there is case and counter case between the parties and there is no specific allegation except of throwing chilly powder against the petitioners. Petitioner no.1 is daughter of Bipati Devi and the petitioner no.2 is the Bhabhi of petitioner no.1.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Rosera in connection with Bibhutipur P.S.Case no.249 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
