JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The two petitioners seek bail in connection with Excise Case No. 92 of 2020, instituted for the offence under Section 30 (a) of Bihar Prohibition and Excise Act, 2018, are persons of clean antecedents.

It further appears from the records that 114 litres of liquor was found kept in a tempo vehicle which was being occupied by the petitioners. The recovery, it has been alleged has been wrongly saddled on the petitioners. The petitioners are neither the owners of the vehicle nor have any concern with the transportation of the seized liquor. The petitioners are stated to be in

Patna High Court CR. MISC. No.16412 of 2020(2) dt.13-05-2020 2/2 custody since 28.01.2020.

Considering the aforestated facts, the petitioners, above-named, are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VII cum Special Judge (Excise), Aurangabad in connection with Excise Case No. 92 of 2020.
