Case No.76 of 2017 for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a), 41 and 38(a) of the Bihar Prohibition and Excise Act, 2016. He is in custody since 15.06.2017.

It is alleged that from the bed room of the applicant 100 bottle and from the kitchen 60 bottles each containing 180 ml. Bomey Whisky have been recovered.

Keeping in view the nature of the allegation and the fact that the petitioner is in custody since 15.06..2017 and there is no possibility of the trial being concluded in near future, this application is allowed. Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the
