JUSTICE RAMESH KUMAR DATTA ORAL ORDER 04-02-2015 Learned counsel for the petitioner is permitted to correct the village of the petitioner in terms of what is stated in the complaint petition in the course of the day.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner prays for anticipatory bail in a complaint case registered under Sections 498A and 494 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case by the complainant and it is the complainant who is not ready to live with him.

Patna High Court Cr.Misc. No.33817 of 2014 (2) dt.04-02-2015 It is further submitted that the complainant had remarried, for which the certificate of Sarpanch and receipt of Vidyapatinagar (Dham), Samastipur dated 9.6.2013 have been produced to show that the complainant was married with one Gautam Paswan on that date.

On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Amit Kumar Paswan @ Amit Kumar, in the event of his arrest or surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each in Complaint Case No.48 of 2013, Tr. No.1379 of 2014 to the satisfaction of A.C.J.M., Dalsingsarai, Samastipur, subject to the other applicable conditions as laid down under Section 438 of the Cr.P.C.
