Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Shambhuganj P.S. Case No. 01 of 2015 registered under Sections406, 409, 420/34 of the Indian Penal Code. The petitioner was the headmaster of Anup Devi Girls High School, Kasba Block, Shambhuganj and the accusation against the petitioner is that he misappropriated the government money, which was inquired by Seven Members Committee and the accusation was found true.

No.12696 of 2015 (3) dt.22-05-2015 2/2 The report of Inquiry Committee has been annexed with the first information report and it appears from perusal of the inquiry report that the inquiry committee found that the petitioner had made excess payment but there is nothing in the inquiry report to show that books had not been purchased nor there is anything to show that construction work had not been done. Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Shambhuganj P.S. Case No. 01 of 2015 to the satisfaction of Learned Chief Judicial Magistrate, Banka subject to conditions as laid down u/S 438(2) of the Code of Criminal Procedure.
