===================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-07-2018 The petitioner seeks bail in connection with Triveniganj P.S. Case No. 158 of 2018 dated 25.04.2018 instituted for the offences under Sections 419, 420, 120(B), 34 of the Indian Penal Code and Section 25(1-B) a, 26 of the Arms Act.
One Anil Kumar Pandit, a co-accused was arrested with stolen motorcycle who disclosed that one of the looted properties viz. a black bag lay in a room in which the petitioner resided. This is the basis for prosecuting the petitioner. From the possession of the petitioner some incriminating articles have been recovered.
The learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.39608 of 2018 (2) dt.09-07-2018 2/2 that the only fault of the petitioner is that he continued to reside in the same room on rent in which co-accused Anil Kumar Pandit stayed.
The petitioner has clean antecedent and he is a student of B.Sc Zoology (H) in a local college at Triveniganj. He is in custody since 26.04.2018.
Regard being had to the aforesaid facts, the petitioner above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, I, Supaul in connection with Triveniganj P.S. Case No. 158 of 2018.
