JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2017 The petitioner seeks regular bail in connection with Barauni (Zero Mile) P.S. Case No. 431 of 2016, registered for offences punishable under Sections 498A, 302/34 of Indian Penal Code.
Allegation against the petitioner is causing dowry death of the deceased, who happens to be wife of the petitioner. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and no specific allegation has been made and he was not present at the time of alleged occurrence. It has also been submitted that I.O. has also not found that any allegation of demand of dowry was made. Further he has been in judicial custody since 12.01.2017.
Learned counsel for the State opposed the prayer for bail and submitted that there is nothing to show that the petitioner was

Having heard both sides, considering the fact and circumstances of the case and also the fact that the deceased is the wife of the petitioner and the death of the deceased was caused inside the house of the petitioner, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of nine months. (Vinod Kumar Sinha, J) sunil/- U T
