Mr.Shantanu Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-06-2020 Due to COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding.
The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioners and learned APP for the State.
The petitioners seek bail in a case registered under Sections 364, 302/34 of the Indian Penal Code.
The prosecution case in brief is that while the informant's son went for walking, the accused persons in conspiracy to each other abducted him with intention to kill. Next day, the dead body of the informant's son was found lying in the field of Jay Prakash Singh having slit of his neck.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of
Patna High Court CR. MISC. No.16914 of 2020(2) dt.02-06-2020 2/2 tampering of witnesses alleged against the petitioners. The petitioners are in custody since 06-12-2019. Charge sheet has already been submitted. The names of the petitioners have surfaced in this case merely on the basis of suspicion. There is no eye witness to the alleged occurrence. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioners in the present case.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances of the case and also the lockdown, the petitioners, above named, are directed to be released on bail on their personal bond to the satisfaction of Sri S.M. Tripathi, learned Judicial Magistrate-Ist Class, Khagaria in connection with Chautham P.S. Case No. 206 of 2019.
Once the normalcy is restored, the petitioners shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each within a period of four weeks to the satisfaction of the court concerned in connection with the aforesaid case.
