JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Rajepur Police Station Case No. 70 of 2014 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

Although, petitioners are named in the first information report but it is specific case of the prosecution that informant was assaulted by other accused and similarly, Pramila Devi was assaulted by petitioner no. 3 Ramil Mahto.

Admittedly, petitioner no. 3 Ramil Mahto has already

Patna High Court Cr.Misc. No.12849 of 2015 (3) dt.22-05-2015 2/2 arrested and therefore, his prayer for anticipatory bail stands dismissed being infructuous.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the remaining petitioners namely, Prabhu Mahto, Decochandra Mahto and Mahadeo Sah in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Sikarahana at Motihari in Rajepur Police Station Case No. 70 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
