JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kanti Police Station Case No. 570 of 2014 registered for the offences punishable under Section 304B/34 of the Indian Penal Code.

Petitioner happens to be father-in-law of the deceased, who died in her matrimonial home within one year of her marriage in other than normal circumstances and there is allegation that she was subjected to cruelty by her-in-laws before her death. Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to grant privilege of anticipatory bail to the petitioner and accordingly, his prayer for

Patna High Court Cr.Misc. No.13039 of 2015 (3) dt.22-05-2015 2/2 anticipatory bail in connection with Kanti Police Station Case No. 570 of 2014, pending in the court of Sub-Divisional Judicial Magistrate, West Muzaffarpur stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
