Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. The FIR of the occurrence of dacoity is against unknown. Petitioner is in custody since 24.04.2017. Investigation of the case is complete.
Submission is that nothing was recovered from possession of the petitioner nor he was ever put on TI Parade during investigation.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where
Patna High Court Cr.Misc. No.44376 of 2018 (2) dt.25-07-2018 2/2 the case is pending in connection with S. Tr. No. 41 of 2017/477 of 2017 arising out of Mahkar Police Station Case No. 67 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
